Your Louisiana Tax Refund May Be Applied to Certain State Debts

Understanding why your Louisiana income tax refund was reduced or withheld.


Overview

If you are due a Louisiana individual income tax refund, all or part of your refund may be applied to certain legally enforceable debts before your refund is issued.

The Louisiana Department of Revenue (LDR) administers Louisiana income tax refunds. When authorized by Louisiana law, LDR may apply all or part of your refund to eligible debts certified for collection.

Many of these debts are administered through the Louisiana Office of Debt Recovery (ODR), the State's centralized debt collection program. ODR uses several collection methods authorized by law, including Louisiana tax refund offsets.

One of the primary legal authorities governing this process is the Louisiana Tax Offset Garnishment Act (LaTOGA).

What Is a Refund Offset?

A refund offset is the application of all or part of your Louisiana income tax refund toward an eligible debt before your refund is issued.

Instead of receiving the entire refund, the offset amount is applied to the outstanding debt.

If your refund exceeds the debt, you will receive the remaining balance.


Who Administers Louisiana Refund Offsets?

Louisiana Department of Revenue (LDR)

LDR:

  • Processes Louisiana income tax returns.
  • Determines refund amounts.
  • Applies authorized refund offsets.
  • Issues refund offset notices.

Louisiana Office of Debt Recovery (ODR)

ODR is Louisiana's centralized debt collection program.

Participating state agencies may refer eligible debts to ODR for collection.

Depending on the type of debt and applicable law, ODR may use one or more authorized collection methods, including:

  • Louisiana Tax Refund Offsets
  • Payment Plans
  • Bank Levies (where authorized)
  • Wage Garnishments (where authorized)
  • Vendor Payment Offsets (where authorized)
  • Other collection remedies authorized by law

Refund offsets are one of several tools available to collect eligible state debts.


What Types of Debts May Be Collected?

Eligible debts may include:

  • Child Support Obligations
  • State Agency Overpayments
  • Delinquent Fees
  • Fines
  • Penalties
  • Other Legally Enforceable Debts Authorized by Law

Not every debt qualifies for a refund offset.


What Happens If My Refund Is Offset?

If all or part of your refund is applied toward a debt, you'll receive a notice that generally includes:

  • Original refund amount
  • Amount applied
  • Remaining refund
  • Agency receiving payment
  • Contact information for questions about the debt

Keep this notice for your records.


What If I Disagree With the Debt?

Questions about the debt itself should be directed to the agency identified on your notice.

Only the agency responsible for the debt can:

  • Verify the debt
  • Correct the balance
  • Release the debt
  • Authorize any adjustment

LDR cannot modify another agency's certified debt.


Federal Tax Refund Offsets

Louisiana tax refund offsets and federal tax refund offsets are separate programs.

If your federal income tax refund was reduced or withheld, it may have been offset through the U.S. Department of the Treasury's Treasury Offset Program (TOP).

LDR cannot:

  • Access federal refund records
  • Explain federal refund offsets
  • Modify federal offsets

If your federal refund was offset, follow the instructions provided in your federal notice.
