Barred From Preparing


Legislative Provisions

Act 526 of the 2018 Regular Session of the Louisiana Legislature authorizes the Louisiana Department of Revenue to bring lawsuits against tax preparers who engage in fraudulent activity. The court may bar the person from acting as a preparer in the State of Louisiana when he or she has engaged in conduct including, but not limited to the following:

  • Prepared any return, report or claim for refund that includes a substantial understatement of a taxpayer’s liability
  • Negotiated a check issued to a taxpayer by the Department of Revenue without the permission of the taxpayer
  • Engaged in conduct subject to any criminal penalty under Title 47 of the Louisiana Revised Statutes
  • Engaged in fraudulent activity that interferes with the proper administration of the tax laws of the State of Louisiana
